Terms of Service / Acceptable Use Policy

Definitions.

"we", "us", "our" - XS2Games.
"you", "customer" - A customer of XS2Games.
"downtime" - A period of time in which the supplied service is unavalible.

1. Duration of contract.

The contract lasts as long as payment has been made for, therefore if a server payment is not received when due we reserve the right to cancel the server and delete all configs. We will warn customers who are nearing the time to renew payment, although it is up to the customer to make sure it is received on time. *We reserve the right to cancel a contract if a customer is found to be violating the Use policy (section 2).
 

2. Use Policy.

Under no circumstances may a customer of ours do the following:

• Promote any illegal activity (such as hacking, spamming, cracking etc).
• Use game server folders to store foreign files.
• You must not use our services to advertise/promote a company seen as competition to us.
• Disobey any of the rules in the server administration rules (section 3)

3. Server Administration Rules.

Users may edit their server config files freely as long as they do not disobey any of the following:

• Edit player slot limits to any other number than what’s stated on their order.
• Remove password when customer is being billed for a private server.
• Change any settings that would increase CPU usage or affect server performance in any other way (this includes adding bots).
• Edit branding in any way (move its position, change its colour/case).
• Put the server private password in the server hostname.

Any problems caused by The Client to servers, (which include, but are not limited to, deletion of necessary operating system files/game server files, accidental or intentional infection by a virus/Trojan, or any other issue which prevents the server from functioning) may result in extra charges to the customer at the discretion of our judgement.

4. Change of service agreement.

?er 1337 reserves the right to change/alter the terms and conditions without prior notice.

5. Recurring payments.

Although we use a billing management system to assist customers, it remains the customer’s responsibility to make payments on time. Therefore if a customer wishes to end their service it is up to them to cancel payment before the installment is due as all payments are non-refundable (please refer to section 9).

6. Contract Price Changes.

If our service costs were to change we may have to renegotiate your contract, should this happen you should be aware it could result in a price increase.

7. Service Outages.

As a customer of ours you shall accept that there may occasionally be problems with the services that could result in server downtime. Also customers must accept that in these cases they will have no breach of contract claim against ?er 1337. If we are made aware of possible service outages all customers will be informed.

8. Server Setup/Creation.

We do offer automated server setup with all web, game and voice server orders, although this is done automaticly via our billing system there is a chance that this my sometimes not go to plan due to server downtime etc. As a result there is no guarantee of instant setup with the servers and we allow at 48hrs for install as a result.

9. Cancellations.

If you cancel your services for what ever reason, there will be no refund apart from special cases.

10. Indemnity:

• All customers must acknowledge that you are solely responsible for the use to which you put the Service, and all information, data and results you obtain from using it and that all warranties, conditions, undertakings, representations and terms whether expressed or implied, tatutory or otherwise are hereby excluded to the fullest extent permitted by law.
• Other than as provided for in this Agreement, Xs2games hereby disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever and howsoever incurred to any customer owned hardware that is placed into our racks/storage.
• You will indemnify xs2games from and against all losses, liabilities, damages, costs, reasonable expenses, actions and claims suffered or incurred by xs2games arising out of or in connection with any breach by you of these Terms.

All customers should be aware that once you use the Service in any way, unless we agree otherwise, you will not have the right under Regulation 10 of the Consumer Protection (Distance Selling) Regulations 2000 to cancel this Agreement within 7 days of entering into it as if the Agreement had not been made. This Agreement has a minimum period (the “initial term”) of 1 month (unless otherwise detailed in your Internet Service Agreement). During this initial period you may not cancel this Agreement without paying all fees due for the period, regardless of whether invoices for these charges have been raised or not. We require a minimum of 30 days notification of cancellations.

 

**Failiure to comply with the above terms will result in possible suspension of account/services without prior notice/refund**
